Quando nel Medio regno apparve una forma di proprietà, la preservazione dei beni e dell’ eredità spettanti ai figli resero necessario l’intervento della legge negli affari di divorzio.
Il diritto legale non interveniva nella regolazione di questo genere di affari privati, che venivano affidati invece al semplice diritto contrattuale.
Dall’epoca saitica sino alla metà del periodo di dominazione del Lagidi, il divorzio era consentito solo al marito. La donna poteva solo salvaguardare i propri diritti mediante contratti che rendevano l’eventualità del divorzio fortemente svantaggiosa per l’uomo.
Per esempio poteva farsi approntare una dote fittizia che il marito, in caso di divorzio, sarebbe stato tenuto a renderle unitamente ad uno speciale vitalizio previsto dalle norme matrimoniali.
Inoltre all’uomo poteva venire inflitta un’ammenda e i suoi beni potevano venire ipotecati per la somma che la donna stabiliva e per l’ammontare dell’ammenda, anch’essa fissata da contratto. Infine, il marito era obbligato a disinvestire i suoi beni a favore del figlio maggiore, in modo che si potesse garantire la certezza dell’annuale versamento del vitalizio dovuto alla donna.
Di conseguenza le formule in calce ai contratti cambiano e al posto del superato:
” Se io ti disprezzo, se prendo un’altra donna, io ti darò …”
si trova:
“A partire da oggi solo tu potrai andartene. Io ti darò …”.
